Terms of Service
1. Agreement
By using the Payfair website (payfair.cash) or the Payfair Android application (together, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by SSD Technologies LLC ("we", "our", "us").
2. What Payfair Is
Payfair is a fare comparison tool. We show estimated prices from ride-hailing providers such as Uber, Lyft, Bolt, FREE NOW, Cabify, Arro, taxi.eu, Cabonline, and others so you can compare before you book.
Payfair does not:
- Provide transportation services.
- Book, dispatch, or arrange rides on your behalf.
- Process payments for rides.
- Employ or contract drivers.
Any ride you take is subject to the terms of the ride-hailing provider you choose. We have no involvement in, and accept no liability for, the ride itself.
3. Fare Estimates
All prices shown are estimates only. They are not guaranteed quotes. Actual fares may differ due to:
- Surge or dynamic pricing by the provider.
- Traffic conditions and route changes.
- Wait times, tolls, and additional fees.
- Provider pricing updates after our estimate was generated.
We display a confidence indicator with each estimate. Estimates marked with fewer bars or labeled "Estimated" carry greater uncertainty. We make reasonable efforts to provide accurate data, but we do not guarantee the accuracy, completeness, or timeliness of any fare estimate.
4. Accounts
The Android app allows you to create an account using your phone number, email address, or Google Sign-In. You are responsible for keeping your login credentials secure. You must be at least 16 years old to create an account.
We may suspend or terminate accounts that violate these terms, abuse the Service, or engage in fraudulent activity.
5. Subscriptions
The Android app offers optional premium subscriptions billed through Google Play. Subscriptions auto-renew at the end of each billing period unless cancelled. You can cancel at any time through Google Play settings. Refunds are handled by Google according to their refund policies.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Scrape, crawl, or use automated tools to access the Service beyond normal use.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Interfere with the operation of the Service or circumvent security measures.
- Create multiple accounts to evade rate limits or bans.
- Impersonate another person or provide false information.
7. Intellectual Property
The Payfair name, logo, website design, and application code are owned by SSD Technologies LLC. Provider names, logos, and trademarks (Uber, Lyft, Bolt, etc.) belong to their respective owners and are used for identification purposes only.
8. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- We are not liable for any loss arising from reliance on fare estimates.
- We are not liable for the actions, services, or policies of any third-party ride-hailing provider.
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless SSD Technologies LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third party's rights.
10. Third-Party Services
The Service relies on third-party providers for mapping, analytics, authentication, messaging, and advertising. Your use of the Service is also subject to their respective terms. We are not responsible for the availability or conduct of third-party services.
11. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
12. Account Deletion
You may request deletion of your account and associated data at any time via payfair.cash/deletemeplease or the "Delete Account" option in the app. Deletion is permanent after a 30-day grace period. Signing in during the grace period cancels the deletion. Anonymized analytics data may be retained after account deletion.
13. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
14. Changes to These Terms
We may update these terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
16. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
